Terms of Service

1. Acceptance of Terms

By accessing or using MarketChamp AI ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

2. Description of Service

MarketChamp AI is a marketing automation platform that analyzes businesses, generates marketing strategies using AI, and helps execute marketing campaigns. The Service includes:

  • Website analysis and business auditing
  • AI-generated marketing strategies and content
  • Social media management and publishing across connected platforms
  • Video creation and rendering
  • Lead capture, scoring, and management
  • Analytics, reporting, and performance tracking
  • Affiliate program management
  • AI-powered customer support chatbot on public pages
  • Marketing automation pipelines (Marketing Autopilot)

3. User Accounts

  • You must provide a valid email address to create an account
  • You are responsible for maintaining the security of your account credentials
  • You must not share your account credentials with others
  • You must be at least 16 years old to use the Service
  • You are responsible for all activity that occurs under your account
  • You must promptly notify us of any unauthorized use of your account

4. Connected Social Media Accounts

The Service allows you to connect third-party social media accounts (LinkedIn, Twitter/X, Facebook, Instagram, TikTok, Pinterest, and Bluesky) to publish content. By connecting an account, you agree to the following:

  • Authorization. You authorize MarketChamp to access your connected accounts solely for the purposes of publishing content you have approved and retrieving basic profile information
  • Platform compliance. You are responsible for ensuring that all content published through MarketChamp complies with the terms of service, community guidelines, and advertising policies of each connected platform
  • Credential security. We store your authentication credentials (OAuth tokens and app passwords) encrypted using AES-256-GCM. You may disconnect any account at any time from your dashboard, which immediately deletes the stored credentials
  • No unauthorized posting. We will never publish content to your connected accounts without your explicit approval
  • Platform changes. Third-party platforms may change their APIs, terms, or features at any time. We are not responsible for disruptions caused by changes to third-party platform services
  • Account ownership. You represent that you own or have proper authorization to connect and publish to each social media account you link to the Service

5. Acceptable Use

You agree not to use the Service to:

  • Generate spam, unsolicited marketing, or bulk automated content
  • Violate any applicable laws, regulations, or third-party rights
  • Infringe on intellectual property rights of others
  • Upload malicious content or attempt to compromise the Service
  • Violate the terms of service of connected social media platforms
  • Impersonate any person or entity, or misrepresent your affiliation
  • Use the Service to harass, defame, or threaten others
  • Attempt to access other users' accounts or data
  • Circumvent usage limits, rate limits, or subscription restrictions

6. Content Ownership

You retain ownership of all content you create or upload to the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service, including:

  • Sending content to AI services for analysis and generation
  • Publishing content to social media platforms on your behalf
  • Rendering videos using your provided text, images, and media
  • Storing and displaying content within your dashboard

This license terminates when you delete your content or close your account. We do not use your content to train AI models or for any purpose beyond delivering the Service to you.

7. AI-Generated Content

The Service uses artificial intelligence (including Anthropic Claude and other AI providers) to generate marketing strategies, social media posts, video scripts, customer support responses, and other content. You acknowledge and agree that:

  • You are responsible for reviewing and approving all AI-generated content before publishing
  • We do not guarantee the accuracy, suitability, originality, or legal compliance of AI-generated content
  • AI-generated content may require editing to meet your brand voice, legal requirements, or platform guidelines
  • You assume full responsibility for any content you choose to publish, whether AI-generated or manually created

8. Video Generation

The Service includes video creation and rendering capabilities. You agree that:

  • You have the right to use all images, audio, text, and media you include in videos
  • Rendered videos consume credits or usage quota based on your subscription plan
  • Rendering times may vary and are not guaranteed
  • We are not responsible for third-party content (stock images, royalty-free music) that may have separate license terms

9. Subscriptions and Billing

  • Paid plans are billed monthly or annually through Stripe
  • You may cancel your subscription at any time; access continues through the end of the billing period
  • Refunds are handled on a case-by-case basis
  • Free trial users have limited access to features and usage quotas
  • We reserve the right to change pricing with 30 days' notice
  • Failed payments may result in service suspension after a grace period

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information, including social media credentials and data from connected accounts.

11. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Loss of data or business interruption
  • Content published to third-party platforms
  • Actions taken by third-party platforms on your account (suspensions, restrictions)
  • Inaccuracies in AI-generated content
  • Service downtime or rendering failures

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless MarketChamp AI, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Service, (b) content you create or publish through the Service, (c) your violation of these terms, or (d) your violation of any third-party rights or platform terms.

13. Termination

We reserve the right to suspend or terminate your account if you violate these terms. You may also close your account at any time. Upon termination:

  • All connected social media accounts are immediately disconnected and credentials deleted
  • Your data will be retained for 30 days before permanent deletion, unless you request earlier deletion
  • Any outstanding subscription charges remain due
  • Provisions that by their nature should survive termination (liability, indemnification, intellectual property) will survive

14. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service at least 14 days before they take effect. Continued use after changes constitutes acceptance of the updated terms.

15. Governing Law

These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation before pursuing formal proceedings.

16. Print Services

16.1 Third-Party Print Fulfillment

MarketChamp offers print file preparation as a value-added service. Actual printing, fulfillment, and shipping are performed by independent third-party providers (“Print Partners”) including but not limited to Gelato, Prodigi, Helloprint, Lob, and PostGrid. MarketChamp is not a party to the transaction between you and the Print Partner.

16.2 Print Preparation Fee

MarketChamp charges a “Print Preparation Fee” for file optimization services including resolution scaling, bleed margin addition, safe zone validation, and format conversion. This fee is non-refundable once file preparation has been completed, regardless of whether you proceed with the print order.

16.3 Limitation of Liability

MarketChamp shall not be liable for: (a) print quality, color accuracy, or material defects; (b) shipping delays, lost or damaged shipments; (c) errors in the final printed product; (d) actions or omissions of Print Partners; (e) differences between on-screen previews and printed output. Maximum liability for print preparation services is limited to the Print Preparation Fee paid for the specific order.

16.4 Refunds

Print Preparation Fees may be refunded if file preparation has not yet been completed. Once a file has been prepared and submitted to a Print Partner, the preparation fee is non-refundable. For refunds related to the printed product itself, contact the Print Partner directly.

16.5 Privacy

When you place a print order, your shipping address and contact information are shared with the selected Print Partner solely for order fulfillment. Each Print Partner's privacy policy governs their use of your data.

17. AI Customer Support Chatbot

The Service includes an AI-powered customer support chatbot available on public pages. By using the chatbot, you acknowledge and agree to the following:

  • AI-Powered Responses: Chat responses are generated by artificial intelligence (Anthropic Claude) and may not always be fully accurate. The chatbot is not a substitute for professional advice.
  • Data Collection: When you use the chatbot, we collect a unique visitor identifier, your messages, any contact information you voluntarily provide (email, phone number), the page URL where the chat was initiated, and basic device information. See our Privacy Policy for full details.
  • Conversation Storage: Chat conversations are stored to provide continuity and support quality. Anonymous conversations are automatically deleted after 90 days. Personally identifiable information is scrubbed from older conversations per our retention policy.
  • Human Escalation: Conversations may be escalated to human support staff at your request or when the AI cannot adequately assist. Human agents will have access to your conversation history and any information you provided.
  • Sensitive Information: Do not share credit card numbers, passwords, social security numbers, or other sensitive credentials in the chat. The system automatically redacts detected payment card and identity numbers, but you should avoid sharing them. Billing issues should be managed at Dashboard → Organization → Billing.
  • Security Measures: We employ input sanitization, output validation, PII redaction, rate limiting, session tokens, and bot detection to protect your conversations. See our Privacy Policy for details on security practices.
  • No Guarantee of Availability: The chatbot is provided as a convenience. We do not guarantee 24/7 availability of AI or human support. Response times may vary.
